Agreement to Terms of Use

These terms and conditions (the “Terms of Use”) apply to the website located at https://kinvale.co.uk (the “Site”) and your use of the same. Please read these Terms and Conditions carefully before using the Site. Using the Site implies that you accept these terms. We do occasionally update these terms so please refer back to them in the future.

Ownership

The Site is owned by Kinvale (“Kinvale, we or us”).

By accessing, browsing and/or using the Site you acknowledge that you have read, understood and agree to be bound by these Terms of Use and to comply with all applicable laws and regulations. Kinvale may alter, suspend or discontinue the Site and your access to use the Site at any time for any reason without notice or liability to you or any third party. The Site may become unavailable due to maintenance or malfunction of computer equipment or for other reasons and may result in damages to the user’s systems or operations.

Although we aim to offer the best service and try to ensure that the Site is free from bugs and viruses, we do not guarantee this or that it will be secure and you acknowledge that interruptions in the availability of the Site may occur. Kinvale has no control over the content on any other website and makes no representations whatsoever about any other website which you may access through this one. Where the Site contains links to other websites and resources provided by third parties, these links are provided for your information only. Kinvale disclaims any and all liability and responsibility for content displayed on any third-party website. A link to a non-Kinvale website does not mean that Kinvale endorses or accepts any responsibility for the content or the use of such website. You agree that we may, in our sole discretion and without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to):

If we do take any legal action against you as a result of your violation of these Terms of Use, we will be entitled to recover from you, and you agree to pay, all reasonable legal fees and costs of such action.

No one other than a party to these Terms of Use has any right to enforce any of these terms.

If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.

If you breach these Terms of Use and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms of Use.

We shall not be responsible for any breach of these Terms of Use caused by circumstances beyond our control.

Applicable Law

These Terms of Use, their subject matter and formation shall be governed and construed in accordance with English law and any disputes will be decided only by the courts of England and Wales.

Entire Agreement

This Agreement constitutes the entire agreement between you and Kinvale with respect to the subject matter of this Agreement and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding that subject matter. Any waiver of any provision of this Agreement will be effective only if in writing and signed by Kinvale.
